Prosecution Delays in the Sia Kamara Murder Trial


The murder trial of Sia Fatu Kamara encountered additional delays on Tuesday, as the prosecution sought a further adjournment. This development jeopardizes the pursuit of justice in the case.


Previously, the prosecution had requested a postponement, citing the need for more time to review case files due to insufficient notice. The court granted this request. However, a week after the previous adjournment, Yusuf Isaac Sesay, representing the state, informed the court that the prosecution intended to adopt a new strategy to accelerate the trial. Consequently, they requested an additional adjournment to finalize their approach.



Abdul Kpaka, a 36-year-old businessman, stands accused of the murder of Sia Fatu Kamara, which allegedly transpired on August 13, 2024, at Peninsula Road, Mambo Village in Freetown. Magistrate Santigie Bangura presides over the case at Pademba Road Court No. 2.


Sesay presented to the court that the proposed course of action aligns with the best interests of justice and aims to expedite the trial process. However, Julian Cole, representing Kpaka, expressed frustration with the repeated delays. He pointed out that the prosecution had previously assured the court that they would present their witnesses by the next adjourned date, only to subsequently request another postponement.



Cole criticized the prosecution's approach, arguing that it undermines the court's commitment to a swift trial. "The prosecution's request for additional time is disappointing," Cole stated. "The court expects progress, and the prosecution has a legal obligation to advance the proceedings since they initiated the case."


He also emphasized that Kpaka's right to a timely and fair trial must be upheld, stressing that justice should be served without unnecessary delays.



Magistrate Bangura acknowledged the gravity of the case and the need for an expedited trial. However, he noted that the court could not compel the prosecution to proceed. He indicated that while he would grant another opportunity for the prosecution to continue, he might have to consider alternative actions if further delays occurred.


The trial has been adjourned until Monday, September 9, 2024.
